Privacy and Personal Data Protection Policy

despak.com.tr takes maximum care regarding the security of your personal data. Your personal data is processed and stored in accordance with the Law on the Protection of Personal Data No. 6698 ("KVKK").

1. How Your Personal Data Can Be Processed

Under the KVKK No. 6698, the personal data you share with despak.com.tr may be processed by us through automatic or non-automatic methods, including recording, storing, modifying, rearranging, or any other operations performed on the data, either in whole or in part, as part of an automated data system or in non-automated ways. Any operation performed on personal data within the scope of KVKK is considered as "processing personal data".

2. Purposes and Legal Reasons for Processing Your Personal Data

Your shared personal data will be processed for the following purposes:

  • To fulfill the requirements of the services we provide to our customers in accordance with the contract and technological needs, and to improve the products and services we offer;
  • To provide information to prosecutors, courts, and relevant public authorities, in cases related to public safety and legal disputes, upon request and as required by law;
  • To offer a wide range of opportunities to our members or share such opportunities with persons or institutions who can provide them, within the legal framework;
  • To analyze advertising preferences;

It will be processed in accordance with the KVKK No. 6698 and the related secondary regulations.

3. Information About Third Parties or Organizations to Whom Your Personal Data May Be Transferred

For the purposes mentioned above, the personal data you share with despak.com.tr may be transferred to our main shareholders, shareholders, advertisers, our domestic and foreign affiliates, especially companies using the infrastructure of despak.com.tr, and other persons and organizations involved in the services offered. Additionally, it may be transferred to third parties and organizations in Turkey and abroad, including service providers and partners with whom we cooperate, or who are processing data on our behalf, in accordance with the law.

4. How Your Personal Data Is Collected

Your personal data may be collected through:

  • Forms on the despak.com.tr website and mobile applications, including information such as name, surname, address, phone, work or personal email address; as well as data on pages accessed by using a username and password, IP logs of actions performed, browser-collected cookie data, browsing times, and location data;
  • People who share their personal data via business cards, resumes (CVs), proposals, or other means for purposes such as establishing a commercial relationship with despak.com.tr, applying for a job, or submitting proposals;
  • Data indirectly collected from various channels, including websites, blogs, contests, surveys, games, campaigns, and social media platforms (Facebook, Twitter, Google, Instagram, Snapchat, etc.) for purposes such as reading or clicking on e-newsletters, publicly available database information, and shared profiles on social media platforms;

This data may be processed and collected.

5. Personal Data Collected Before the Enactment of the KVKK

despak.com.tr did not begin its operations before April 7, 2016, which is the enactment date of the KVKK. Therefore, no personal data was stored before this date. (If your website collected data before this date, it must be clearly stated how the data was processed and stored.)

6. Transfer of Your Personal Data

Your personal data, collected by the methods listed above, may be transferred to foreign service providers located in countries deemed to provide adequate protection for personal data, as accredited by the Personal Data Protection Authority, in accordance with the purposes of the contract and within the scope of the KVKK.

Your personal data may also be transferred to:

  • Our business partners with whom we collaborate and/or from whom we receive services to provide and promote our products and services;
  • Authorized authorities to detect your location in case of an emergency;
  • Regulatory and supervisory authorities, courts, enforcement offices, and other official institutions, and public institutions authorized to request personal data;
  • Legal entities having your phone number and in a commercial relationship with despak.com.tr;

In necessary situations, your data may be transferred as outlined.

7. Storage and Protection of Personal Data

despak.com.tr is obliged to take necessary software and physical security measures to prevent unlawful processing of personal data and unauthorized access, as per Article 12 of the KVKK. This includes hashing, encryption, logging, and access control systems. In case of unlawful acquisition of personal data, it will be immediately reported to the Personal Data Protection Board in accordance with legal regulations.

8. Keeping Personal Data Accurate and Up-to-date

In accordance with Article 4 of the KVKK, despak.com.tr is obligated to keep your personal data accurate and up-to-date. To comply with current regulations, our members must share or update their accurate and current data via our website/mobile applications.

9. Rights of the Data Subject Under the KVKK No. 6698

Article 11 of the KVKK, which came into effect on October 7, 2016, outlines the following rights for data subjects:

The data subject may apply to despak.com.tr (data controller) to:

  • Learn whether personal data is being processed;
  • Request information regarding the processing of personal data;
  • Learn the purpose of personal data processing and whether the data is used in accordance with its purpose;
  • Know the third parties to whom personal data is transferred domestically or abroad;
  • Request the correction of incomplete or inaccurate data;
  • Request the deletion or destruction of personal data under the conditions outlined in Article 7 of the KVKK;
  • Request that corrections, deletions, or destructions be communicated to third parties to whom personal data has been transferred;
  • Object to results arising from automated processing of personal data, which negatively affects the individual;
  • Request the cessation of unlawful processing of personal data;
